Gugatan ini dilakukan karena WALHI menilai sejumlah pasal dalam UU tersebut melemahkan perlindungan terhadap lingkungan hidup dan melanggar prinsip keadilan ekologis.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Dalam keterangan persnya, WALHI menyebut gugatan ini merupakan bentuk <strong>perlawanan terhadap pelemahan sistem perlindungan lingkungan yang dilegalkan melalui UU Cipta Kerja<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8220;Berlakunya UU ini meruntuhkan prinsip pembangunan berkelanjutan yang demokratis,&#8221; ujar <strong>Zenzi Suhadi<\/strong>, Direktur Eksekutif Nasional WALHI. <em>Dikutip dari CNN News.<\/em><\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p class=\"wp-block-paragraph\">WALHI mempermasalahkan sejumlah ketentuan, antara lain:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Pasal 13 huruf B<\/strong><\/li>\n\n\n\n<li><strong>Pasal 22 angka 1 hingga 28<\/strong><\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Pasal-pasal tersebut dianggap:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Membatasi partisipasi publik<\/strong> dalam proses AMDAL hanya untuk masyarakat terdampak langsung.<\/li>\n\n\n\n<li><strong>Menghapus ruang kontrol masyarakat dan organisasi lingkungan<\/strong> dalam proses penilaian kelayakan lingkungan.<\/li>\n\n\n\n<li><strong>Melemahkan pengawasan negara<\/strong>, seperti ketentuan izin lingkungan yang dicabut tidak otomatis membatalkan izin usaha.<\/li>\n\n\n\n<li><strong>Mengandalkan sistem digital<\/strong> untuk akses informasi, yang dinilai menyulitkan masyarakat di daerah terpencil.<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Dasar Konstitusional Gugatan:<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Tim Advokasi untuk Keadilan Ekologis menegaskan bahwa gugatan ini berpijak pada sejumlah pasal dalam <strong>UUD 1945<\/strong>, seperti:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Pasal 1 ayat (3)<\/strong> \u2013 Negara hukum<\/li>\n\n\n\n<li><strong>Pasal 28H ayat (1)<\/strong> \u2013 Hak atas lingkungan hidup<\/li>\n\n\n\n<li><strong>Pasal 28C ayat (1) dan (2)<\/strong> \u2013 Hak mengembangkan diri dan memperjuangkan hak kolektif<\/li>\n\n\n\n<li><strong>Pasal 28F<\/strong> \u2013 Hak atas informasi<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">&#8220;Dalam kajian kami, pasal-pasal dalam UU Cipta Kerja yang digugat <strong>bertentangan langsung dengan prinsip-prinsip dalam UUD 1945<\/strong>,&#8221; ujar <strong>Mulya Sarmono<\/strong>, tim kuasa hukum WALHI.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p class=\"wp-block-paragraph\">Kuasa hukum WALHI, termasuk <strong>Alif Fauzi Nurwidiastomo dari LBH Jakarta<\/strong>, mengungkapkan proses pendaftaran gugatan berjalan lancar. Namun, mereka mencatat adanya <strong>pembatasan kebebasan berekspresi<\/strong> terhadap massa solidaritas di sekitar Gedung MK.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8220;Kami tinggal menunggu ARPK dari MK.
